This assignment looks at Hirabayashi 1943 case and Korematsu 1945 case. Hirabayashi was a young, first-generation Japanese American student at the University of Seattle. Hirabayashi blatantly refused to follow curfews imposed on the Japanese community after Pearl Harbor. Korematsu’s case significance is similar to the relevance of the Hirabayashi case. Hirabayashi also planned to disobey the impending removal order for all Americans of Japanese descent to internment camps. He had, therefore, built a relationship with Quakers and AFSC staff in the region. Looking at the Hirabayashi 1943 case and Korematsu 1945 case, we can see the Japanese Americans are the people involved.

KOREMATSU 1945 CASE AND THE COURT’S DECISION
The assignment also highlights the Court’s decision of the Hirabayashi 1943 case and Korematsu 1945 case. The U.S supreme court on December 18, 1944, upheld the conviction of Fred Korematsu. Korematsu then got convicted for violating an exclusion order requiring him to submit to forced relocation during World War. On May 3, Korematsu 1945 case Exclusion Order Number 34 got issued. The issue ordered the relocation of 23-year-old Korematsu and his family. Although his family followed the order, Korematsu failed to submit to relocation. He got convicted in a federal district court and also received a sentence of five years’ probation. Korematsu’s case significance is visible where The Supreme Court agreed to hear his appeal and made its ruling.

KOREMATSU COURT RULING AND KOREMATSU CASE SIGNIFICANCE
The supreme court ruling is similar in both the Hirabayashi 1943 case and Korematsu 1945 case ruling both involved the Supreme Court. Korematsu is the only case in Supreme Court history in which the Court, used a strict test. The test upheld a restriction on civil liberties. Korematsu 1945 case has since been severely criticized for sanctioning racism. Justice Black did not find that Fred Korematsu had been discriminated against because of his ethnicity. Instead, Black and his fellow justices found that Korematsu had disobeyed orders that were justified by military necessity. The Court majority did not question the military’s claim of how Japanese Americans threatened national security. The Court furthermore did not examine how reducing this threat meant temporarily excluding the entire group. Korematsu’s case significance is, therefore, evident.
